Terms
This is a translation of the Dutch terms. In case of any difference, the Dutch text prevails. Voorwaarden (Nederlands)
Version 2026-10-17 · applies to licences purchased from this date onwards.
1. Who sells you a licence
Havun (sole proprietorship), Jacques Bloemhof 57, 1628 VN Hoorn, the Netherlands. Registered with the Chamber of Commerce (KvK) under number 98516000. Reachable at info@fotusa.nl.
2. What you buy
Full use of Fotusa during one year, on up to 2 computers per email address. What you make and fill in during that year keeps working afterwards (article 8). No VAT charged — small businesses scheme (kleineondernemersregeling, Article 25 of the Dutch Turnover Tax Act 1968).
The licence is registered to the email address you buy with; you use it to activate the app and to reach your licence overview. If your address changes, email us and we will change it. Email you will receive in any case is about your licence; email about new versions only if you ask for it when you buy, and you can switch that off again in your licence overview. Your address is never passed on to anyone else.
3. What you may do with the licence
The licence is for your own use, at home or at work, on 2 computers that you use yourself and with as many photos as you like. Buying again on the same address extends the licence but adds no computers. Reselling, lending, sharing or bypassing the licence check is not allowed; we may then revoke the licence, and unless it is blatantly obvious we write to you first. The software itself remains ours.
4. Updates and help
Updates are free and part of the licence. They are on the download page and the app tells you about them; we never fetch anything without you doing it yourself. Skipping an update is fine: your version keeps working. As long as your licence runs, we keep Fotusa working on the systems it is supplied for.
A question or a problem? Email info@fotusa.nl. We help by email, usually within a few working days, and you always get an answer.
5. Renewing and cancelling
The licence does not renew automatically; we do not have subscriptions, and we never charge anything unless you choose so yourself. A little over a month before the end date you receive an email. If you want to continue, you buy again at the price of that moment; if you do so before the end date, the new year follows on from it and you lose no days.
There is no need to cancel: the licence expires on the end date. What you have made and filled in keeps working afterwards; only nothing new is added (article 8).
6. Trying it out and the cooling-off period
You can try Fotusa for free, unlimited in time. Without a licence the app shows a thousand files, of which at most ten videos; the rest stays on your disk and is added once you activate.
There is no cooling-off period: you waive it when you buy, because you were able to try Fotusa first. That is why there is no refund if you change your mind. There is one if the app does not do what is stated here (article 7) or if we stop (article 11).

7. If the app does not do what is stated here
If Fotusa does not work as described on a computer that meets the system requirements, let us know. We will work it out with you, for example with the error report from the app, and fix it in an update. If that does not succeed within a reasonable time, you can terminate the purchase and you will get back the part of the year you were unable to use.
8. What the licence does not do
After the end date, your work stays yours. You can keep viewing, searching and exporting everything that is in Fotusa at that moment, with your names, albums, tags and places. What stops: reading in new photos and folders, computing, and adding or editing.
The computed files are in the folder .Fotusa - rekenwerk (niet aankomen). After the
end date Fotusa no longer rebuilds them: if that folder is lost or damaged, the app works as it
does without a licence, with a thousand files. Your photos, what is in them (tags, captions,
stars, location) and your names and albums remain yours and readable, even without Fotusa.
You can release a computer at most 3 times per calendar year; reinstalling on the same computer does not count.
9. What we do not guarantee
Fotusa is not a backup. Make your own copies of your photos; we are not liable for files you lose in some other way.
Restoring is a safety net, not a guarantee. Fotusa keeps a log for 365 days of
what the app changes in your files. What the app throws away where there is no Windows recycle
bin (a network folder, a USB stick, a file too large for the bin) it keeps for 30 days by
default (adjustable from 7 to 90) in .Fotusa - prullenbak on the same disk.
Restoring also works after the end date.
We do not guarantee that the app works on every computer with every setting, or that this website is always reachable; the app works without internet until the end date. Otherwise we are liable as the law provides, and your rights as a consumer always apply.
10. Your data
What we store: your email address, country, payments, and two things for each computer you activate: its name, so you recognise it in your licence overview, and a fingerprint of motherboard, disk and Windows, so the licence recognises it. That fingerprint contains no serial numbers. For a computer or sign-in link request also the IP address, against misuse. After 30 days they are deleted. Stripe processes payment details, not us. We do not sell your data and we do not track you.
Error reports only reach us if you send them from the app yourself, without folder, file, person or album names. They contain the app version, the number of files and folders, your graphics card, the error, how far the running tasks were, what you add yourself or attach (such as a screenshot) and, with a licence, its email address. We read them, also with the help of Claude by Anthropic (United States), only to fix the error, and we keep them for 90 days. On its own the app never sends your photos and videos, or folder, file, person and album names, to us or to anyone else. The restore log stays with you and never reaches us.
What for: to supply, renew and revoke your licence and to inform you about it. We also keep payments for tax purposes.
Who else is involved: Stripe (payment and invoice), Brevo (our email to you, EU) and our server in the EU. A question in the help chat of the manual goes to Anthropic (United States) for the answer, without email addresses and phone numbers, and we do not keep it; if you forward the conversation to us, we receive it with your email address in order to reply. An error report you send may be read by Anthropic to help fix the error. No one else, and we send no advertising.
Cookies: this site sets two cookies, both needed for the site to work (form protection and your session), valid for two hours and without tracking; that is why there is no cookie notice.
How long: payments seven years (tax retention obligation); your email address and licence while it runs, then only in the accounts until those seven years are up.
What you can do: view, correct, delete or take your data with you — email info@fotusa.nl. What falls under the retention obligation can only go after seven years. You can lodge a complaint with the Dutch Autoriteit Persoonsgegevens.
11. If we were to stop
Then your licence remains valid until the end date; it is in the app and does not need our server. You will hear it from us in advance, and a paid licence that becomes unusable through our fault is refunded pro rata.
12. Changes to these terms
A new version applies to licences bought after it. For your licence, what applied when you bought it remains in force, unless we notify you of a change in advance.
13. If something goes wrong
Email us; we will look for a solution together. If that fails, you can go to the Dutch courts, and from another EU country the European Consumer Centre can mediate free of charge. Dutch law applies.
